2. Definitions
- "Platform" — The CaseMate casework management software and services
- "User" or "You" — Any individual or organisation using the Platform
- "Tenant" — A separate instance of the Platform with isolated data
- "Content" — All data, documents, and information uploaded to the Platform
- "Subscription" — A paid plan providing access to the Platform
3. Acceptance of Terms
By creating an account, placing an order, or using the Platform, you acknowledge that you have read,
understood, and agree to be bound by these Terms of Service. If you do not agree to these terms,
you must not use the Platform.
4. Subscription Plans & Payment
4.1 Subscription Plans
We offer the following subscription plans:
- Quiet: £15/month — 1 user, 1GB storage
- Active: £25/month — 1 user, 1GB storage
- Campaigner: £30/month — 1 user, 3GB storage
- Hero: £50/month — 10 users, 5GB storage
All prices exclude VAT. Annual billing options available at a discount.
4.2 Payment Terms
- Subscriptions are billed monthly or annually in advance
- Payment is due on the anniversary of your subscription start date
- We accept payment via Direct Debit (GoCardless), card (Stripe), or bank transfer
- Late payments may result in service suspension
- Prices may be subject to change with 30 days' notice
4.3 Free Trial
New subscriptions include a 14-day free trial. You may cancel at any time during the trial
period without charge. After the trial, your subscription will automatically convert to a
paid plan unless cancelled.
5. Platform Usage
5.1 Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these terms. You must not:
- Use the Platform for any illegal or fraudulent purpose
- Upload, store, or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
- Attempt to gain unauthorised access to the Platform or related systems
- Interfere with or disrupt the integrity or performance of the Platform
- Reverse engineer, decompile, or disassemble any part of the Platform
- Use the Platform to send unsolicited communications (spam)
- Exceed the storage, user, or feature limits of your subscription plan
5.2 Data Protection & GDPR
As a user processing personal data through the Platform, you are a Data Controller under GDPR.
We act as a Data Processor on your behalf. You agree to:
- Only upload personal data you have a lawful basis to process
- Obtain necessary consents where required
- Respond to data subject requests (access, deletion, etc.)
- Maintain appropriate data retention and deletion policies
- Notify us promptly of any data breaches or security incidents
5.3 Electoral Register Data
If you use the Platform to store or process electoral register data, you acknowledge that:
- Electoral register data must be used only for the purposes permitted by law (e.g., electoral purposes, campaigning)
- The full register may not be used for commercial purposes
- You are responsible for ensuring your use complies with electoral law and local authority requirements
6. Data Ownership & Security
6.1 Your Content
You retain all ownership rights to the content you upload to the Platform. By uploading content,
you grant us a limited licence to host, process, and display your content solely for the purpose
of providing the Platform services.
6.2 Our Security Commitments
We implement industry-standard security measures including:
- Encryption of data in transit (TLS 1.3) and at rest
- Per-tenant database isolation
- Regular security updates and patches
- Access controls and authentication
- Regular backups with point-in-time recovery
6.3 Data Export & Portability
You may export your data at any time through the Platform's data export feature.
Upon subscription termination, we will retain your data for 30 days to allow export,
after which it will be securely deleted.
7. Service Level & Support
7.1 Uptime Commitment
We target 99.5% uptime for the Platform, excluding scheduled maintenance. In the event of
unplanned downtime exceeding 4 hours, we will provide a pro-rata credit for the affected period
upon request.
7.2 Support
We provide support via email ([email protected])
during business hours (Monday–Friday, 9am–5pm UK time). We aim to respond to support requests within
24 hours during business hours.
8. Termination
8.1 By You
You may cancel your subscription at any time through your account settings or by contacting us.
Cancellation takes effect at the end of the current billing period.
8.2 By Us
We may suspend or terminate your account if you:
- Breach these Terms of Service
- Fail to pay fees when due
- Engage in illegal or harmful activities
- Misuse the Platform in a way that affects other users
8.3 Effect of Termination
Upon termination:
- Your access to the Platform will cease
- We will retain your data for 30 days to allow export
- After 30 days, your data will be securely deleted
- Any accrued payment obligations remain due
9. Limitation of Liability
9.1 Our Liability
To the maximum extent permitted by law:
- Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim
- We are not liable for indirect, consequential, or special damages
- We are not liable for loss of profits, revenue, data, or goodwill
- We are not liable for any failure to perform due to circumstances beyond our reasonable control
9.2 Your Responsibility
You are responsible for:
- The accuracy and legality of all content you upload
- Maintaining the confidentiality of your account credentials
- Ensuring your use of the Platform complies with applicable laws
- Backing up your data (though we maintain our own backups)
- Obtaining necessary consents for processing personal data
10. Intellectual Property
The Platform, including all software, designs, logos, and content provided by us, is owned by
Jon Hubbard t/a Technoliga and protected by copyright and other intellectual property laws. You may not
copy, modify, distribute, or create derivative works without our prior written consent.
11. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant
changes by email or through your account. Continued use of the Platform after changes
constitutes acceptance of the updated terms.
12. Governing Law & Jurisdiction
These Terms of Service are governed by the laws of England and Wales. Any disputes will be
subject to the exclusive jurisdiction of the courts of England and Wales.
